Module 2

Knowing your share

If your father, your mother, your husband, and your brother all died on the same day — what would you inherit?

Scenario

Noor receives three different WhatsApp explanations about inheritance. One says daughters inherit nothing if brothers exist. Another says a will decides everything. A third says the eldest son chooses. Faraid is the answer — and it is more precise than family rumours.

Fixed shares

Under Faraid, certain heirs receive fixed shares set by Islamic law.

This is why guessing is dangerous.

A daughter inherits

A daughter inherits mandatorily when sons are present. Her share is half of each son's share, and it is hers by right.

A smaller share is still a right, not a favour.

A wife's share

A wife inherits one-eighth of her husband's estate if there are children, and one-quarter if there are not.

The family structure matters.

A Wasiat

A Wasiat can usually direct up to one-third of the estate to non-heirs. The remainder is governed by Faraid.

A will does not erase Faraid.

Check yourself

A Muslim woman is survived by her husband, two sons, and one daughter. Which is true about her daughter's share?

Correct answer: The daughter inherits a fixed share, smaller than each son's but mandatory. Sons affect the ratio, but they do not erase the daughter's right.
